These Terms and Conditions comply with the relevant provisions of the Indian Constitution and the Indian Information Technology (IT) Act, 2000.

Please read all the terms very carefully before using the Miko Software Services Application & Website. By using our application, you are agreeing to the terms and legal norms of our services. One should not use the application or the services if you do not accept the terms.

Definitions

• “Services” or “service” means the services we provide through our application or Website.
• “Customer” or “you” or “your” means the users or customers who is using the application and services provided by us.
• “We”, “Us”, “Our” or MSS means the service provider, who is providing the services through the application or website.
• “Content” means the data available in the application or website. Any data or information like photos, videos, locations, details, etc., uploaded by us, customers, or users, are regarded as the content.

User Conduct

• Users must adhere to the laws of India, including the Indian Penal Code (IPC) and the Information Technology Act, 2000.
• Users shall not post any content that is defamatory, obscene, discriminatory, illegal, or infringes the rights of any person or entity.
• Users are responsible for ensuring that any information shared, including requests for blood, event postings, comments, and messages, is truthful and accurate.

Use of platform and services

• You should agree and confirm that you must not copy, upload, download, modify the content belonging to our application or another person. You shall not transmit or share any information which is harmful, racist, gross, defamatory, pornographic, criminally inciting, or invasive of another’s privacy, hateful and objectionable in any way.
• The use of this Software and the Services by you is non-exclusive.
• Subject to your device settings, the Software may automatically download and install updates from time to time.
• This Software and the Services may not be sold or otherwise distributed by you for commercial gain.
• Except as provided under the present terms and conditions, the Software and the Services may not be copied, replicated, or modified and the source code/algorithm may not be extracted or used in any way without our express written consent.
• You authorize us to use any feedback you provide without compensation and without prior notification to you.
• You agree to receive mandatory and optional notifications from us via the email address provided by you. You may request to opt-out of optional notifications.

Posting Blood Requests and Events

• Users may post blood requests, donation events, and other relevant information. However, all posts must comply with Section 66A of the IT Act, which prohibits the dissemination of offensive messages and misinformation.
• MSS reserves the right to remove any content that violates the law, the rights of others, or these terms and conditions.
• Users must not post misleading information or false requests that could cause harm to individuals or the public.

Privacy and Data Protection

This Privacy Policy (“Policy”) describes the policies and procedures on the collection, use, disclosure, and protection of your information when you use our application.

Please read the privacy policy carefully before using the application or submitting any information to us. This Policy is a part of and incorporated within, and is to be read along with, the Terms of Use.

• User data collected through the app, including personal details and health information, will be handled in compliance with the Indian IT Act, particularly Section 43A and Section 72A, concerning data protection and privacy.
• Users' chats, posts, and personal data will be protected, and MSS will not disclose user data to third parties without consent unless required by law.
• By using our application and the Services, you agree and consent to the collection, transfer, use, storage, disclosure, and sharing of your information as described and collected by us in accordance with this Policy. If you do not agree with the Policy, please do not use or access application.
• We may occasionally update this Policy. If we make any significant changes to this Policy, we will endeavor to provide you with reasonable notice of such changes, such as via prominent notice on our app or to your email address on record, and where required by applicable law, we will obtain your consent. To the extent permitted under the applicable law, your continued use of our Services after we publish or send a notice about our changes to this Policy shall constitute your consent to the updated Policy.

Data we collect

We collect various data from you and your device in order to serve you a better experience. We collect device information like hardware configuration, operating system, software versions, mobile network information, etc. We also collect data of your personal information like Name, date of birth, location, etc. which you provide to us. The information collected thus will be disclosed to or collected directly by these plugins and may be used to improve the content and/or functionality of the services offered to you. Analytics companies may use mobile device IDs to track your usage of the application.

Following and Communication

• Users can follow other donors and communicate with them through the app. However, all interactions must remain respectful and must not violate any laws related to harassment or abuse.
• Any misuse of the chat or comment features, such as sending offensive or threatening messages, is prohibited and may result in termination of account access.

User Responsibility

• Users are solely responsible for the content they post or share through the app. This includes, but is not limited to, posts about blood requests, donation events, comments, and messages.
• MSS will not be held liable for any loss or damage arising from reliance on any information posted by users.

Content Moderation and Removal

• MSS reserves the right to review, moderate, and remove any content that violates these Terms and Conditions, the Indian IT Act, or is deemed inappropriate, harmful, or false.
• Users who repeatedly violate the rules may be subject to suspension or permanent removal from the app.

Intellectual Property

• All intellectual property rights related to the app, including its design, software, and content, are owned by MSS.
• Users do not gain any ownership rights to the app or any associated intellectual property by using the app.

Termination of Service

MSS reserves the right to suspend or terminate any user's access to the app at any time, with or without notice, if a user is found to be in violation of these terms, Indian law, or if deemed necessary for security or legal reasons.

Account Deletion Policy

• Users may request to delete their accounts at any time through the app's settings or by contacting MSS directly.
• Upon account deletion, all personal data, posts, messages, and related information will be permanently removed from the app, and this action cannot be undone.
• MSS may retain certain information as required by law or for legitimate business purposes, but this will not be linked to the deleted account.

Limitation of Liability

• MSS is not responsible for the accuracy of the information posted by users, including blood requests, events, or comments. The app functions as a platform for users to connect, and all interactions and posts are the responsibility of the users.
• The company will not be liable for any damages, losses, or legal disputes arising from the use of the app.

Amendments to Terms and Conditions

MSS reserves the right to modify these Terms and Conditions at any time. Users will be notified of any significant changes, and continued use of the app will be considered acceptance of the revised terms.

DATA SECURITY PRECAUTIONS

We value your privacy. It is our top priority and we have taken every possible measure to protect your information collected by us. We make sure that every sensitive information used by a third party is very well protected. You are advised not to share any bank details, ATM pin, card number, CVV, OTP, etc. with any unencrypted third party. Do not share your id or password with anyone. You will be responsible for your outcome if you share any of your personal information.

When you sign up for our platform, you may receive promotional offers, emails, etc. You can deregister your account anytime you want and opt-out of this. If you want to delete your information from our database you can write to us.

Governing Law

These Terms and Conditions are governed by the laws of India. Any disputes or legal proceedings will be handled under the jurisdiction of the courts of India.

Amendment

We change our terms and policy from time to time. You are advised to check the terms and keep updated. Using this platform, you are agreeing to these updated terms and conditions.
